Maltese Mailings and the Podgecast Returns

When I was at school, copying someone else’s work and putting your name on it was called cheating; later, at university, the word was plagiarism.

What name, then, would we use for putting your website’s address across pictures taken by another photographer?

Dunk might have permission to use training photos. I would imagine that they’re from the Press Association. I know for sure, though, that he didn’t take them; partly because it’s hard to keep your camera hand steady when balancing on a wheelie bin, but mainly because one of them had already appeared on thisisanfield.com and that particular image had been linked to by a KT member. Therefore, Dunk really shouldn’t be implying that they’re his by plastering http://www.koptalk.coN across each one. (UPDATE: see the official LFC site for training photos.)

And, Dunk, those photos aren’t hosted on KopTalk so, unless you’ve added photobucket to your cyberspace empire, then I’m not sure how people linking to them will affect your bandwidth, though that’s obviously one reason you plaster your dying site’s URL all over them — you’re actually hoping that they will link, giving you a free plug!

The other day, I mentioned how you can’t search for a member’s posts on KopTalk. One of the other services they offer for your £30 is ‘protection’ from your forum friends who might want to message you; to meet up for some pints during the match, say, if you all live locally. Some Maltese members were discussing just that, with the idea being to set up a mailing list to keep in touch and organise such events.

Katie my love, i already opened a support ticket to which you replied you would discuss it with Dunk and get back to me. All we want is a way for us Maltese members to communicate outside of the forums so we can organise some get togethers for games. That is why i think a mailing list would be the best solution, but obviously you would have to ask everyone if its ok to share there email addresses and then send us or me everyones address so i can start it off.

I think that ozi was the same member who suggested meeting Dunk when he was due to be visiting Malta. Dunk squirmed at the time, evidently hoping it would be forgotten. Wasn’t he supposed to be flying out a couple of weeks ago to spend the summer there? Unless I’ve missed something, that hasn’t happened, either.

The problem is, Dunk doesn’t want his members interacting where he can’t keep his beady eye on them, because they might tell one another about the blog or, even worse, free sites where you can actually message one another without opening endless support tickets for ‘permission’, and where you can read rumours that weren’t made up by him.

Finally, before I finish my lunch, some good news from KopTalk.

The podgecasts definitely aren’t as funny as Only Fools and Horses, but they do feature someone who appears as if he may have known a Del in the past (see this earlier blog article).

We all know Dunk reads the blog. It gives him free publicity (imagine how much quieter his site would be if we didn’t). So, if anyone has any questions for the podgecast, leave them here for him, and we can watch later and hear them answered. I’ll start things off: Has David L got his prize yet?

    Can someone show me one of the training ground pics and I’ll try to find the source?

    If they are stolen then we’ll be able to notify the relevent agency and also get Photobucket to remove them.

    Right, I’ve delved deeper.

    The pics are from Getty Images and if they have genuinly been paid for they will almost certainly be for editorial context only. This means that they cannot be used for promotional purposes.

    By adding the site url and hosting them on a filesharing service Duncan Oldham is breaking such a contract, regardless of where he himself chooses to use them on Koptalk.

    I have called Getty’s sales department to notify them of this and suggest everyone else does the same. The more calls they get the more chance there is of them doing something about it.

    In Rupert’s absence I think its important that we all take responsibility for action, rather than just commenting on contributors’ articles.

    As with all the sets of images Oldham puts on his site, the training images are from the Press Association. They were taken by a PA photographer called Peter Byrne.

    Insider said a while back that Oldham has access to PA Sports images because he managed to get KT registered with the Premier League.

    Oldham himself commented on this a few days ago. I’ll dig out his quotes later.

    Thanks, Andy. I thought that they were probably from the PA. I couldn’t find them on Getty Images myself.

    Whatever the source, I think we can be sure that they wouldn’t grant permission for him to imply that they were his work, or even his copyright, by emblazoning them with his URL.

    In the past, I have seen him do the same with PA photos that, when they were used elsewhere, had the PA logo left intact. One recent example was when he posted photos of Gerrard’s wedding on his site. The BBC had some of the same pictures, but credited the PA. Naturally, he did not.

    As when he lifts ‘insider’ news from elsewhere, Oldham is seeking to gain credit where he deserves none.

    This is Oldham’s explanation of how he accesses these photos. From what Insider said, I don’t think Oldham has to pay for them as he is registered with the Premier League. I have no idea whether registering your site with the Premier League entails paying a fee. Given that Oldham lies incessantly about the costs of running KT, I doubt it:

    Those kind of photos we buy yes. You can either buy a set amount each month from an agency e.g. 30 photos for a set fee or you can do what we did and negotiate your own deal. I prefer unlimited deals so that you don’t have to count and because I wanted to make sure our members got to see a lot of colour (as they brighten news items up). Before working with agencies you must be licenced (depending on the competition) and that costs a tidy sum each year on top of the monthly payments. Even if you take your own photos you must still be licenced.

    I know this doesnt have anything to do with this article but just checked the alexa stats and noticed that 19.1% of Kraptalk users come from mauritius yet during my short time as a member I never saw anybody who said they were from Mauritius. Could Dunk be “hiding his ass”?

    As for the pictures, Dunk says on his own site, the following:
    “KOPTALK is registered with the Premier League as a fans website.

    Images not taken by ourselves are supplied by third parties under licence from them and must not be used online without the consent of Football Dataco and the supplier of the images”

    So he says that the images are suppied by third parties under licence, did that licence include KT being allowed to brand the pictures with the name of the site?

    PA photos is an agency, totally separate from Football DataCo. PA photos used to be Empics and his contract with them will be in addition to being registered with the Premier League.

    Use of the photos will still be under strict restrictions and will almost certainly be editorial context only, so by watermarking them and uploading them to a filesharing service he will be in breach of the terms.

    In fact, if you visit the links section of their website, they link to http://www.kraptalk.com, which was an excellent spoof site and now directs to the blog. 🙂

    I should also say regular users of Koptalk know which photos are ones that have been taken by Koptalk themselves.

    If you are suggesting that the users on Koptalk think all these photos have been taken by Dunk or his”minions” you are mistaken. When Dunk personally makes a trip to Melwood we get the full nine yards of how wonderful Dunk is which so irritates you people. I just switch off that part of his self publicising off.

    But when he gets film that he shot himself of Newcastle’s chairman saying he would walk Owen back to Liverpool, thats the sort of thing which users of Koptalk love about Dunk.

    It’s good to hear that KT members are fully aware that most of the images Oldham posts come from PA.

    Insider has said a couple of times that Oldham has access to PA images because KT is registered with the Premier League. Hopefully Insider can clear this up for you next time he’s around. I don’t know whether Oldham has to pay for this PL registration.

    Oldham did use to regularly try to create the misleading impression that the PA images were his own. He explicitly stated on several occasions that they were taken by a “Koptalk photographer”. It was only when the blog kept exposing this lie that he stopped doing so. Thumbnails of the PA images used to be accessible to the public, so we’d just post links to them.

    He may pay for the pics or otherwise have legitimate access to them. Please read my articles properly. I even stated that above. What I am questioning is whether that gives him the right to plaster his site’s URL across them.

    Other unofficial sites sometimes use agency photos. As I said, one of them was on thisisanfield.com; however, they hadn’t watermarked it. I also mentioned the Gerrard wedding photos.     Some will know. You obviously do. There are plenty of foreign users on there, though, who haven’t a clue how these deals function. The other day, I saw a comment that said, “Thanks, Dunk! Quality work, guys!” It wasn’t the only one in similar terms, either. Dunk doesn’t say he took the photos, but he certainly doesn’t dispel the notion that he did if anyone wants to wrongly assume it. Adding his watermark only lends weight to that.

    So, you presume now to speak for ‘users of KopTalk’, do you? Is that an elected position that enables you to express the collective view for the blog? Maybe you love it about him — do you? Maybe some others do. There are always a few sycophantic comments after those events. However, they’re only ever a small proportion of the membership, if Dunk’s claims for his numbers are true (ahum). If his antics were really so beloved by the members, we wouldn’t have access through donated accounts and we wouldn’t have information sent in to us by members.

    The watermarking of pictures. I think its picky and hardly worth an article. I cant get excited about it, but I do accept what you say that some users probably think Dunk has taken them. I still dont see a big problem. At the end of the day its a chance for that guy in mauritius to see pictures.

I’d rather listen to the expertise of those who do run forums that posted their comments here, so that’s fair enough.

    He’s replaced them now, that’s why. It took him long enough, though. If you posted a link to the blog, it would have been gone in minutes; other concerns seem somewhat less pressing.

    I accept that you may not have seen the ads. Banner ads work on rotation and, unless you sat there refreshing, there’s a good chance you wouldn’t have seen it if you logged in a couple of times a day.

    I understand that. I don’t expect you to act as Dunk’s defender-in-chief. He himself has and always has had an open right of reply on the blog, which he’s never chosen to take. He sometimes spends considerable time ranting obliquely about campaigns, blogs, ‘rivals’ and ex-members, but he never offers the hard evidence that would refute what’s detailed here and thereby convince any doubters. Why, I wonder?

    With respect, though, Nick, you can’t fully understand the basis of the blog if you don’t investigate and address its biggest concerns. You come here and pick up on specific small points, which no-one obliges you to, but you choose to focus on them and ignore the major issues, so you can’t blame those who don’t take you as seriously as you might deserve. At least read that last article I linked to and investigate the links in it. You’re clearly prepared to spend 10 minutes here and there to read certain articles and respond, so please invest a similar time period in reading this article and this article, and then let me know what you think afterwards. I’d really appreciate that effort.

    It’s funny you mention Mauritius, because independent stats indicate that he currently derives more members from there than any other country, including the UK. That despite his recent claims that the majority of users are UK-based.

    And I refute that, anyway. I linked in this article to training photos on the official site. I note that they didn’t watermark them, either.

    Your ignorance is clearly very comforting for you. Why don’t you want to open your eyes? it may be a little embarrassing initially: when you find out that you were wrong, you misjudged Dunk’s character, and yes…he always was a lying, robbing shithouse.

    No one likes to find out they were wrong, do they?

    But it’s not too late…

    you still have a chance to claim back a bit of respect, (Read up, make your own mind up) but if you carry on like this – popping in and out and commenting on things you clearly do not understand (or want to understand, seemingly), Dunk is going to end up making you look an even bigger mug than you do already.
